References to statutory provisions refer to the European General Data Protection Regulation (GDPR) and to Hesse Data Protection and Freedom of Information Act (Hessisches Datenschutz- und Informationsfreiheitsgesetz, hereinafter “HDSIG”) or to the comparable provisions of the relevant federal statutes and statutes of the federal states in the relevant applicable version.
This privacy policy information applies to the database of translators and interpreters provided on the internet by the federal-state justice departments and to the personal data collected via these websites. For websites of other providers to which reference is made, for example, by links, the privacy policy information and declarations there apply.
Under Art. 4 GDPR, personal data are all information relating to an identified or identifiable natural person. An identifiable natural person is one who can be identified directly or indirectly, in particular by reference to an identifier such as a name, an identification number, location data, an online identifier or to one or more factors specific to the physical, physiological, genetic, mental, economic, cultural or social identity of that natural person.
Personal data are processed in the database of translators and interpreters. The federal-state justice departments are joint controllers under Art. 26 GDPR and Section 39 HDSIG for the joint operation of the database of translators and interpreters. The steps in the process under joint control are the access for research to the central application, the display of meta data and contents within the database of translators and interpreters and the provision of contents as the result of the access for research combined with the option of downloading and printing.
For all other steps in the process, in particular the admission[1] of translators and interpreters to the database, the storage and processing of personal data in the filing systems of the authority competent in each case for registration, sole controller is this registration authority for the purpose of Art. 4, No. 7 GDPR.
As part of the joint control, the state of Hesse justice department is responsible for processing the data within the infrastructure provided for the operation of the database of translators and interpreters, including the implementation of all necessary technical and organisational measures. The state of Hesse justice department concludes an agreement on processing under Art. 28 GDPR or Section 3 (2) HDSIG with the serviceprovider assigned, Hesse Centre for Data Processing (Hessische Zentrale für Datenverarbeitung, “HZD”). Otherwise the federal-state justice departments are each responsible in the area of joint control for the data originating from their jurisdiction.

The internet service is hosted by Hesse Centre for Data Processing (Hessische Zentrale für Datenverarbeitung, “HZD”) as technical service-provider on behalf of the state of Hesse federal-state justice department and according to its instructions.
Your data are processed for performance of the tasks of the relevant federal-state justice department. Legal basis of data processing, unless more specific legal principles are applicable, is Art. 6 (1) Sentence 1 letter e. GDPR in conjunction with Section 3 (1) HDSIG.
Personal data of translators and interpreters stored or processed in the database are provided to users of this website for information purposes with the aid of the search function. There is no provision to third parties going beyond this, i.e. there is no further automatic processing of the data.

Where the federal-state justice departments process your personal data, you have the following rights as data subject which arise in particular from Art. 15 to 18, 21 GDPR:
Under Art. 15 GDPR, you can demand information about your personal data processed by the relevant federal-state justice department. In your application for information, you should specify exactly what you wish to know in order to facilitate the compilation of the necessary data. Please note that your right to information is restricted by the provisions of Section 24 (2), Section 26 (2) and Section 33 HDSIG.
If the information concerning you is not or no longer correct, you can require rectification under Art. 16 GDPR. If your data are incomplete, you can require their completion.
Subject to the requirements of Art. 17 GDPR and Section 34 HDSIG, you can demand the erasure of your personal data. Your right to erasure depends, inter alia, on whether your personal data are still required by us to perform our statutory duties.
Under the stipulations of Art. 18 GDPR, you have the right to require a restriction of the processing of your personal data.
Under Art. 21 GDPR, you have the right to object to the processing of your personal data on grounds relating to your personal situation. Nevertheless, the federal-state justice departments cannot always comply, for example, if the federal-state justice departments are obliged to processing in order to perform official duties under a legal regulation as defined in Section 35 HDSIG.
